Acceptance of Terms

By using this website or placing an order, you agree to these Terms of Service and to the policies referenced in them, including our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, do not use the website.

Eligibility

You must be at least 18 years old, or have the involvement of a parent or guardian, to place an order. Orders are accepted for delivery within the United States only.

Products and Descriptions

We aim to describe products accurately. Colors and finishes may vary slightly from photographs because of screen settings and natural material variation. Some photographs include plants, soil, seeds, tools, or other items for display. Only the items listed under a product's features or included items are part of the purchase.

Nominal sizes describe the product's general size class and may differ slightly from measured dimensions.

Pricing and Errors

All prices are in US dollars. We may correct pricing, description, or availability errors at any time. If an error affects your order, we will contact you before processing it, and you may cancel without charge.

Orders and Acceptance

Submitting the checkout form sends us an order request. It is not a binding sale. A contract is formed only when we confirm your order by email, including the final total, shipping charge, and any applicable taxes. We may decline or cancel any order request, for example where an item is unavailable or delivery is not possible to your address.

Payment

Payment details are not collected on this website. After reviewing your order request, we email you the confirmed total and a PayPal payment request. You can pay with your PayPal account, or with Visa or Mastercard through PayPal. PayPal processes the payment, and we do not receive your full card number. Your order ships after payment is received.

Shipping and Risk of Loss

Shipping is governed by our Shipping Policy. Risk of loss passes to you when the carrier delivers the order to your shipping address.

Returns

Returns and refunds are governed by our Return and Refund Policy.

Product Use and Safety

Use products only for their intended purposes and in line with any included instructions and our Tool Safety Notice. Cutting tools, saws, and items requiring assembly or mounting call for care. Keep tools away from children.

Intellectual Property

Website content, including text, photographs, graphics, and the Daily Garden Tools name and logo, belongs to Daily Garden Tools or its licensors. You may not copy or reuse it for commercial purposes without written permission.

Limitation of Liability

To the fullest extent permitted by law, Daily Garden Tools is not liable for indirect, incidental, special, or consequential damages arising from use of the website or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these terms limits rights you have under applicable consumer protection law that cannot be waived.

Indemnity

You agree to indemnify Daily Garden Tools against claims arising from your misuse of the website or products or your breach of these terms.

Governing Law

These terms are governed by the laws of the State of Oregon, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Multnomah County, Oregon, unless applicable law requires otherwise.

Changes to These Terms

We may update these terms. The effective date at the top of this page shows when they were last changed. Orders are governed by the terms in effect when the order is confirmed.
